Complaint regarding stay at Carvoeiro Mar

I would like to reply to biifa's message - although he/she is almost always correct in his/her knowledge I do feel it is a bit unfair to elaborate on what was the situation 14 years ago.

The current status is that the pool belongs jointly to all the owners of the site by virtue of a legal condominum. The pool has just recently been fully refurbished, the cost being paid by the owners as is the monthly maintenance of the pool and gardens.

The pool is not open to the public, but can be used freely by residents at Carvoeiro Mar or by customers of Bubbles Bar who pay a small fee.

I hope this information is appreciated by readers of the Forum - I am, incidentally, an administrator of the official Condominium Carvoeiro Mar.

Thank you for your own compliment about Carvoeiro Mar being organised.

Re the original complaint, I believe that the subject is between the parties concerned and is for them to discuss with each other.

Many thanks for all the friendly (and not so friendly) replies. There is far more to this than meets the eye at first, be assured.

I still need answers though, in particular pictures of Bubbles Bar's advertising all over town (signs with Bubbles Bar/Pool on) and of the Bellevue Appartments (from the road, with the road on it). Also, any previous complainants out there? I know that at least one person complained before me.

I did like Carvoeiro a lot, but did not like being sold a luxurious holiday in accordance with individually agreed characteristics (and the corresponding price tag) when in fact I ended up in mediocre package holiday accommodation. Not everybody knows their holiday destination in advance, that is why I paid lots of money to somebody who chose it for me on the basis of my specifications (not). The burden is on the agent, not on me, to make sure that it sells me a holiday that corresponds with the description...

I do sympathise if all was not ok.. however I question the validity of phoyographs that you need people to take nearly a year later.
Why didnt you take the said pics?
Why didnt you gather your own evidence at the time if the place want living up to expectations?

Evidence from third parties so late on will hold no weight now.

And why ask others to do your work.... come out here and gather what you want yourself.

I agree with the guest (and for those who know me that doesn't happen very often!).

Dagmar, as you quite rightly point out it is the duty/burden of the agent to provide the holiday you paid for however it is also your responsibility to gather the evidence if that it not the case, at the time.

Photo's taken possibly upto ten months after the event are of little use and may not reflect the situation when you stayed there.

You also say that there is alot more to this than meets the eye and I have no doubt that there is, otherwise you wouldn't be complaining but if you wish the members of this forum to be both sympathetic and undertake research for you it would be nice if you had the courtesy to elaborate.

At the moment it simply looks if you are complaining of a designated restaurant space actually being run as a restaurant and a communal pool being used by people other than yourselves.

I am sorry that I am not being that helpful but I simply fail to see your case particularly retrospectively.

Thanks for agreeing with common sense.

If things had of been as bad as Dagmar is alluding to he would have made sure he returned to his Holiday Company with all necessary info and evidence.

Its too late now to prepare a case and rude to expect others to gather facts that quite frankly will be laughed out of any negotiations to be had.

With reference to the above posts and complaint..... any information received now will only be hearsay.

Who is going to produce the evidence and verify that it was, as it was almost 2yrs ago?

I'm afraid that the complainant should attempt to either presue the claim as it stands or give up and move on.

A fact of life... we live and learn.

Through lack of evidence this case should never have been brought to trial by the CPS (Carvoeiro Prosecuting Service) and I hereby draw a halt to the proceedings?! :wink:
