as we're changing from residents to holiday makers we're going to rent our villa out a little bit
can I ask for a show of hands of how many people have got the official licence to rent please? we're deciding whether to apply or not

A show of hands will reveal those who think it is Ok to flount the law and those who prefer to be lawful and not "visible". By law you have to have a rental licence and failure to get one would result in a very heavy fine. Is it worth it? Only you can decide whether you want to face fines on a possible annual basis or not.

Another issue. If you don't have a tourist licence does your public liability insurance count? What would happen if a guest made a big claim against you for negligence?

Strange way to decide whether to comply with the law or not, can't imagine why anyone would want to confess on line to renting illegally & in any event how will the result of your poll help you? It's a matter of conscience, a bit like fiddling your tax return or inflating a claim on insurance, you might get away with it, many do, and it will save you a few euro's but you won't be proud of it.sunman wrote:as we're changing from residents to holiday makers we're going to rent our villa out a little bit

How would you react if I asked for a show of hands about who never pays for any work in cash?

I am no expert on the rental market either but having owned and rented for 9 years have concluded that both owners & villa rental agencies are prepared to ignore the legal requirements. The authorities appear to have neither the enthusiasm or resources to "police" compliance, consequently the "so what nobody bothers" attitude prevails with a proportion of owners.
I suspect that one thing leads to another ........... No licence means you don't / can't declare rental income / pay tax / adhere to insurance policy small print / partner with a responsible or legally compliant letting agent.
If you decide to rent out your home legally & comply with the above you are unlikely to turn a profit but you may offset some of your fixed costs, good luck sunman, if you need a recommendation on villa management or letting agents don't hesitate to pm me.

I'm sure there are those who take a chance and rent without a licence.
What you have to consider are the implications if you are caught by the authorities. Financial penalties, impact on any substantial insurance claim, potential tax investigations in both countries.
Information is shared so easily these days.
Unless you are an habitual law breaker (which I am sure you are not) you will never really relax.

My understanding is that a long term rental (more than 90 days) does not require a rental licence - holiday rental does (1-89 days). No doubt the experts will put me straight.
